Debt Settlement Instead of Bankruptcy

Sometimes debt settlement and negotiation is an alternative to bankruptcy.  For debt settlement in Kansas the person or organization must be an attorney licensed in Kansas, or, they must be approved by the Office of the State Banking Commissioner.  See www.osbckansas.org and click on List of Approved Registered Credit Services Organizations  for the current list of approved agencies.  Note that currently only two are located in the State of Kansas.

The payments set up by debt settlement agencies often are more than your current minimum payments.  You can still be sued by your creditor.

Generally you will get more favorable settlement terms if an attorney negotiates settlement.  The creditor knows the attorney could defend you if they sued you, and, if you have a bankruptcy lawyer representing you in debt settlement then they know you mean business and need serious reductions in your payments.
